People, 2024 CO 64 (September 30, 2024); Life without the possibility of parole sentence for felony murder is not categorically unconstitutional, nor is the sentence grossly disproportionate following the General Assembly’s 2021 reclassification of that offense from an F1 to an F2.

(04:42) In re. People v. Whittington, 2024 CO 65 (September 30, 2024); The PH court abused its discretion by excluding evidence after the government conceded, and the court found, that the government violated Rule 16 discovery requirements. The court failed to make sufficient findings to justify such a “severe” sanction – even though the government proposed this sanction and stated that it never intended to use the evidence.

(08:45) People v. d’Estree, 2024COA106 (October 3, 2024); The trial court reversibly erred in denying the defendant’s motion to suppress evidence seized from his cell phone. The first warrant obtained by the police lacked sufficient particularity and was a prohibited general warrant. The government failed to establish under the independent source doctrine or the inevitable discovery doctrine that the search under a second warrant was reasonable.
