When TLR was formed in 1994, Texas was known as the Wild West of Litigation. Unfortunately, that environment has crept back into our civil justice system. Texas now leads the nation in outrageously large verdicts in injury cases, known as Nuclear Verdicts. These are often handed down in cases in which the plaintiff was at fault or suffered little or no damage. Texas job creators are taking this unstable litigation environment into consideration before relocating to Texas. In this episode, we discuss Nuclear Verdicts and the 89th Texas Legislative Session. Takeaways: The legislative session is currently in its early stages, with significant work expected in the upcoming weeks as the House begins to organize and hold committee hearings. Nuclear verdicts refer to jury verdicts of $10 million or more in personal injury or wrongful death cases, which are becoming increasingly prevalent in Texas. Texas is experiencing an alarming increase in nuclear verdicts, with some cases resulting in judgments exceeding $100 million, leading to detrimental effects on the economy. The litigation environment in Texas has deteriorated to the extent that businesses are reconsidering their operations due to the high cost of lawsuits and insurance settlements.
